2020 AGM POSTPONEMENT

Due to the uncertainty of travel, laws around gatherings and timing issues caused by the Covid 19 Pandemic, the Trustees have voted to postpone this year’s AGM and election, usually held in September or October. A new date will be advised in due course.

The Annual reports will be produced as normal, can be downloaded from the Trust Website www.rmlt.co.nz  on the General News Page or the AGM page in late September. There is no longer a need to have a password to access the AGM or Owners Page. If you have any questions email us on contactus@rmlt.co.nz.

For those who request hard copy communications these will be mailed out around the same time.

The Trustees are also taking this time to ask your assistance to fill in the attached registration form with your name and address details, to insure that RMLT has your latest address, email and postal, and also your bank account numbers as cheques are no longer a form of legal tender. This form also asks if you prefer email or postal communication. The default method is email, but if you wish to receive hard copies of RMLT material, you need to request this on this form.

We have over 2000 beneficial landowners for whom we have no contact details or whether they are alive or deceased. We would ask that if you know of any of these people or their names and whereabouts could you please either contact us by email on contactus@rmlt.co.nz or send them a copy of the registration form.

If they have not yet succeeded to their entitlements, we can provide some assistance through this process.

The Trustees of the Rakiura Māori Lands Trust (RMLT) invite the beneficial owners to submit business for the 2019 RMLT Annual General Meeting.

Date of AGM : Sunday 29 September, 2019
Time : Registration from 10am, Meeting commences at 11am, Meeting finishes at 3pm.
Venue : Halfmoon Bay Community Centre, Golden Bay Road Oban, Rakiura
Morning Tea and Lunch provided

The AGM will be held in accordance with the Trust Deed and Standing Orders.  The Trustees will present a report on those activities of the Trust and financial performance for the 2018 and 2019 Financial Years.

AGENDA: Owners are hereby provided the opportunity to notify the Trustees of any item they would like to have considered for the Agenda, by completing the ‘Request for Agenda Item 2019’ form enclosed, and returning it to the postal or email address as stipulated by 4pm Friday 16 August 2019. Upon receipt of any items the Trustees will set the final Agenda and notify owners of all formal business. Owners unable to attend the meeting have the provision to cast their vote through those methods available.
The proposed Agenda is as follows, subject to adjustment of any Agenda items received.

MEETING:  No additional items are able to be added to the Agenda at the meeting.  A timeline for Agenda items will be set to enable for the meeting’s completion within the allotted time.  

ELECTION OF TRUSTEES:  The Trustees hereby call for nominations to fill two vacancies arising from Trustees Jill Skerrett and Tina Nixon, retiring by rotation. Both retiring Trustees are standing for re-election. The successful Trustees will be appointed for a term of three years.   

Those wishing to be nominated for the position of Trustee must complete the enclosed / attached ‘Nomination for election as Trustee 2019’ form and return to RMLT, Ashton Wheelans, P O Box 13042, Christchurch 8141 or email Rakiura@ashtonwheelans.co.nz  by 4pm Friday 16 August 2019.  No nominations for Trustees will be accepted after this date or from the floor on the day of the meeting.
 
FURTHER MEETING INFORMATION: Those wishing to Travel  to Rakiura for this event are advised to book travel and accommodation as soon as possible as both have limited capacity. There will be travel options listed and an agenda of tours and events on Saturday 28th, which will accompany this notice Owners will receive all formal meeting information and voting forms 30 days before the AGM.

The Trustees of the Rakiura Maori Lands Trust (RMLT) invite the beneficial owners to submit business for the 2018 RMLT Annual General Meeting. This Year we plan to stream the AGM live on our website (www.rmlt.co.nz)- go to the media page. You may be asked for a pass word:   Name – landOwner  (case sensitive)  Password  – L@nd0214 (the 0 is the number zero)

The entire meeting will be streamed and will remain available for viewing for 30 days. Viewers will be able to follow proceedings, but voting is only available via the usual channels outlined later in this communication.

2017 AGM

The 2017 AGM was held on October 8th 2017.
Richard Manning was returned as Trustee in the ballot.
The Trustees remuneration review was passed by majority.

The full minutes of the 2017AGM will be available in the first mail out for the 2018 AGM in May/June  2018.

The AGM dates for 2018 are yet to be advised.

RMLT AGM

In order to participate in the Rakiura Maori Lands Trust AGM you must have succeeded through the Maori Land Court to one of the Rakiura Maori Lands Trust blocks listed in Schedule 1 of the Trust Deed.

Available on request

A copy of the Standing Orders for the AGM meeting, which have been used since 2006 are available on request. Also copies will be available on the day of the meeting.

Voting options

(Should be read in conjunction with the Standing Orders for more details)

Voting in person

By attending the meeting you are able to participate fully in all aspects of the meeting including the opportunity to hear all viewpoints before you make any final decision. This option allows you  to fully participate in the governance process.

Appointment of alternate

If you cannot attend you can appoint an alternative person to represent you. This person can participate in the meeting on your behalf as if you were there yourself. They vote and speak on your behalf however, an alternate can only represent one person at the meeting and therefore, if they are already an owner then they must choose whether they represent you or themselves but not both.

Appointment of proxy

If you cannot attend you can appoint a proxy to vote on your behalf. The proxy is either the chairperson of the meeting or another person eligible to participate in the meeting. Your proxy has the right to include your vote in the same direction that they themselves cast their vote. You do not provide your proxy with speaking rights on your behalf but simply allow then to add your vote to theirs. Those holding proxies can only speak once not for each proxy.

Note: That with both alternate and proxy voting you have no control over your representative if they change their mind on the direction of your vote at the meeting and decide to vote in a direction that you have not approved. The arrangement between the proxy/alternate and the owner they are representing is outside the scope of the meeting and you will be bound by the decisions of the meeting as if you were there.

Postal Voting

The trustees will allocate opportunities for you to complete a postal vote on the key issues determined by the trustees. You must complete your vote on the approved form prior to the meeting and send it back to the Trust as indicated. Under this provision your vote on each of the issues available will be tallied to the other forms of voting once the vote has been taken and not before this point. You have no speaking rights and any comments written on the forms will not be read out to the meeting.

Whānau spokesperson

If you have put your land into a Whānau Trust we require you to complete a form to determine who is representing and speaking for the Trust to avoid any confusion on the day of the meeting. A form is included in this notice.

Whānau Trusts

Wwhen land is held in a Trust, the Trust is the registered beneficial owner and as a result, any information is disseminated to the contact details we hold on file for this owner. The recipient of any information is responsible to converse with members of the Whānau Trust and determine appropriately what course of action is required.

Apologies for the AGM

If you wish to have your apology recorded in the minutes of the meeting you will need to register this by contacting via email or postal address the Rakiura Maori Lands Trusts prior to meeting. The contact details are recorded at the bottom of the page with the material attached.

General Business

All registered beneficial owners were provided with the opportunity to submit items of General Business in the Pre-AGM meeting notification. We have received and processed these requests and the Agenda has been set and no more items of General Business will be accepted on the day of the meeting. This process ensures that all owners have the ability to participate in the business of the meeting in a fair and equitable way, and ensures those who cannot attend are not disadvantaged and can use the postal voting on General Business items and election of trustees.

The Rakiura Maori Land Trust held their AGM at the Te Rau Aroha marae in Bluff on Sunday.

After what was described as a tumultuous few years of change the Rakiura Maori Lands Trust is in a financially strong position.

The Trust held its AGM at Te Rau Aroha marae in Bluff on Sunday with about 40 beneficial land owners attending.

The trustee report says it had been a positive year as the trust ushered in a new business partnership with Real Journeys while divesting itself of surplus assets.

Rakiura Maori Lands Trust chairman Simon Gomez said the trust was in a good position after what had been a few years of turmoil with changes in trustees and the negotiation of the deal with Real Journeys.

Trustees Leon Fife and Dick Ryan were up for re-election and as no one stood against them they remained in their positions, Gomez said.

The trust finalised its deal with Real Journeys and purchased the kiwi spotting business run by Phillip Smith as Bravo Adventures.

Operations begin on Tuesday under a new company "Wild Kiwi Encounters Partnership" with the trust as a 50 per cent share holder and Real Journeys running the operational side, the report says.

The trust was expecting to make a reasonable profit within three or four years, Gomez said.

The trust carried out its plan, which was created in 2015, to divest itself of assets which were non-earning or surplus to requirements, the report said.

It sold a vessel, the Matariki, sold a building in Bluff and sold smaller assets such as dinghies and pontoons.

The Trust is also in negotiations with a possible new tenant for the Pearler's building on the foreshore in Halfmoon Bay.

Negotiations were expected to conclude some time in November, Gomez said.

The trust reallocated its investment portfolio with Canterbury-based company Murry and Co which flourished in the early part of 2016 with some substantial gains, the report said.

For the first time the Trust showed a modest profit from hunting activities in 2015, the report said.

Hunting facilities were being upgraded and were expected to be completed before the next hunting season.

The trust has made several applications for funding to Te Puni Kokiri, the Ministry of Maori Development, to support various projects being undertaken.

The trust applied for funds, and was successful, to carry out research on the Neck studying kiwis, yellow eyed penguins and the ecosystem.

A further grant was applied for from the Department of Conservation for a pest eradication effort at the Neck, the report says.

The application was successful and the trust has plans to launch an assault on predators in the near future.

The last time the trust carried out pest control in 2008 there was an 80 per cent knock back in pest numbers, the report says.

The trust also applied for funding to assist the Rakiura Heritage Centre in housing historical records, artefacts and toanga.
